Legal Question in Credit and Debt Law in Texas
credit fraud during marriage
While married, a non-working woman with no credit history of her own, used credit applications sent to her husband to obtain credit cards without his knowledge by forging his signature. She charged over $20,000, most of these charges appear to be cash advances. When her husband found out, he filed for divorce. It was determined by the court judge that she be responsible for the debt. Four years later she stopped paying and creditors have come after the husband. Is he responsible for the debt?

Re: credit fraud during marriage
The husband is responsible for the debt because the creditors were not a party to the divorce decree. If the wife is not obeying the order of the Court, she is subject to contempt.
