Legal Question in Credit and Debt Law in Texas

Credit reports

We had a cell phone service that we cancelled. We didnt hear anything for about 2 1/2 years and then out of the blue a collection agency calls us. I tried to explain that I was a single mom trying to get my credit straightened out, and that I would be glad to make small monthly payments. The agent refused to listen, claimed she had an attorney on the other line listening in. Is that legal? And if they bring a judgement against me, what exactly will that entail? I really don't want to go to court or be sued, but this agent wouldn't listen to reasoning, claimed she heard all the bull before from others.

Yes they can have an attorney on the phone extension, but doubt if they did. Most lawyers have better things to do.

Yes they can sue you for the balance according to the terms of the contract.

You don't need their permission to make payments. Send them $10 a month until you can get to a point where you can send them more. They are not likely to sue you if you are making payments, and know that it is all you have.

The phone calls may continue, but unless they rise to the level of harrassment, there is little you can do about it.
