Legal Question in Credit and Debt Law in Texas

Credit Reprot Problem

I had a Discover card that I was not able to pay on. The last payment I made was in 1989. On my last credit report it showed up again and showed a payment (last activity) 1996. I contacted the credit bureau and stated that the report was not true. They responded with a letter stating that the creditor disagreed. What recourse do I have?

Re: Credit Reprot Problem

The statute of limitations for suit on a debt in Texas is 4 years. A debt may be reported on your credit report for 7 years from the date of last activity. You should dispute the debt IN WRITING with each of the three credit reporting agencies as well as Discover card and send them certified mail, return receipt requested. If it still does not come off, you have a cause of action under both the Fair Debt Collection Practices Act and the Fair Credit Reporting Act.
