Legal Question in Credit and Debt Law in Texas

Creditor lost credit card information

I joined a fitness center and monthly payments were withdrawn from my account through a debit card I gave them when I joned. My card was stolen and I gave the center my new number. I recieved an email from the manager saying she lost my number. I gave the number to the staff 3 more times. They sent the account to collections while I was still using the center. I sent a letter to the collection agency and a month later I received a letter from another collections agency. They want me to pay 2 years worth of fees. They only accept payments through bank drafts and I gave them my card number on 4 separate occasions. I talked to the manager when I noticed the payment had not come from my account. She said 2 payments would be withdrawn the next month. Instead of a withdrawal, the account was sent to the collections agency. Am I liable for payment of 2 years of service I can't use?

Re: Creditor lost credit card information

Do you have statements that prove you made the payments? Include these with a registered letter to the collection agency and the fitness center demanding that they cease and desist further collection efforts. If you have not made the payments as agreed under your contract, you are quite likely for 2 years of service. That was likely in your contract.
