Can a creditor sue for an unpaid balance even though we do not have the money to pay them? Can they garnish our wages if pursued?

Yes, they can sue you. Your ability to pay the debt is absolutely immaterial.

No, they cannot garnish your wages to collect a judgment. It's against the law in Texas.
