Legal Question in Credit and Debt Law in Texas
Debt collection on manufactured home
I let a manufactured home go back to the lender in 2004. This past month I started receiving letters and calls from a collection agency wanting to collect the remaining balance. The home was auctioned off in 2004, and it only sodl for $10,000, which left a $29,000 balance on a single wide, 4 year old mobile home. If they take me to court, what happens then? If they win their judgement, is there any way they can forceably take money from me, cause right now I can't afford 2 house payments or a lawyer.

Re: Debt collection on manufactured home
Unless you have some very solid legal defenses, they'll get judgment against you for $29,000.00 plus interest on the $29,000 from 30 days after you defaulted on your note, plus attorney fees, plus costs of court, plus interest on the entire judgment until paid.
The prospects of their collecting is a very different story, since Texas is a debtor's haven.
