Debt Collection Rights
Received notification from debt collector demanding balance payment of $4242 for surgery from over 7.5 years ago. Never received a statement from hospital in question which has since gone out of business. I have contacted collection agency via phone and registered mail requesting official documentation, but have received nothing from them other than another notice offering a ''deal'' (if you will) to pay 50 cents on the dollar by 6/27 and they will drop the request. They said I had to contact the insurance company to get documentation of what was paid against the procedure. I do not believe this is my job to prove that I owe this money. I have not worked for the company who carried the insurance coverage for over 7 years and am not sure who the insurance company was. I am not going to agree to pay anything until I see official paperwork which they have not provided. What are my rights and is there a statute of limitations for this since I never did receive anything in 2000 from the original creditor of which the collection agency also agreed we never did receive....

SOL is 4 yrs from last payment. You do not have to prove the debt. You do have to prove any payments or credits that you claim reduces the balance. contest the amount by certified mail telling them of SOL.
