Legal Question in Credit and Debt Law in Texas

my wife had a account that was charged off back 1998 in the sum of $6000.00 Just recently she got served papers from the local courts saying that a new collection agency is sueing her for 10,000.00 which includes 25.9% interest.Do we contact them and try to set up payments or does it have to go through court now that it has been filed in our local county court? If they place a judgement on her when and how does she pay it? We donot have 6000.00 or 10,000 to pay to anyone. Thanks for your help!

You have to answer the lawsuit. I'd also suggest you contact a lawyer to assist you, since you may just have the defense of limitations in your favor.
