can a debt collector seize my tax refund if i cash it first at bank where my acct is even if they know about acct but i dont have a judgement even though they filed suit against me i check my credit report for me and my wife and did not see any. also how long does it take for them to freeze my acct.

A debt collector doesn't "freeze" a bank account. IF he has a judgment, he can garnish your bank account.
Filing a lawsuit is not the same as actually having a final judgment.
Here's my suggestion: Take the IRS refund check to a different bank, and use it to open up an account.
