Legal Question in Credit and Debt Law in Texas

debt

I co-signed for my brother to get a car. He failed to insure the vehical, totaled it and now he will not pay the note. Is there any way for me to take him to court and get a judge to put a judgement on him or garnish his wages. We moved in together and he agreed to pay 1/3 of the rent and 1/3 of the electricity. He moved out without letting me know and now I am stuck with everything. Can I do anything about this? I am worried about my credit. He also has over $1000.00 in not paid cell phone bill that is also in my name. Please help me to know if I have any options.

Thanks,

Re: debt

You can file a lawsuit against anyone, so long as the basis for the lawsuit is valid and not illegal. As for the vehicle bill, you might be able to recoupe the money based upon the terms of the written documents. As for the rent and electricity, did your brother sign any documents to show that he was responsbile for the payments? As for the cell phone, did your brother sign anything saying that he would be responsible for the payments? Without more facts, it is difficult to provide you with a clear and definite direction to proceed in. If my law firm can assist you with this legal issue or any other legal matter, please contact my legal assistant Jennifer ([email protected]).
