Legal Question in Credit and Debt Law in Texas

debt from deceased spouse

My father-in-law passed away and left my mother-in-law in ALOT of debt...some she knew about and some she didn't. If she didn't sign the paperwork for the loan or credit card, is she liable to pay the debt? She has no savings and only income of a small social security check. Also, we found that one loan had collaterol on it, but he had sold the collaterol...what will happen with that loan?

Re: debt from deceased spouse

normally a probate lawyer would answer all questions...if there are assets, such as a home, which may need to be probated..etc..but if she was not on the loans/credit cards she is not obligated.. generally ..unelss she is induced to guaranteeing the debts..so tell her not to agree to anything..
