Legal Question in Credit and Debt Law in Texas

Debt incurred during Manic Episode

My sister is diagnosed as Bipolar Manic Depressive. During her last manic episode she incurred major debt and financial obligations. Is she legally required to pay these debts or can she/we terminate certain bills, i.e., cell phones, time shares, without having to pay exhorbitant fees?

Re: Debt incurred during Manic Episode

Manic or not, she incurred the debts and is responsible for them.

Re: Debt incurred during Manic Episode

There is an old saying out there that if you ask three attorneys for their opinion on something you are going to get four opinions back. With that said here is my opinion. Generally, speaking if a person is incapacitated when making a contract they can void the contract. Especially, if the other party knew of the incapacitation. I would go to the companies and explain the situation and see if they will cancel the contract. They may not and at that point you may want an attorney to look at the matter with all the facts in from of him or her. I could not tell if you were in TX or GA. I am licensed in GA so if your sister incurred these debts there I would be happy to help out at that point, for a fee course.
