My debt shows on spouses credit report

After being put on disability, i contacted all my creditors to arrange payment through CCS. One of my creditors refused and told me the payment amount I offered was not sufficient ($50.00 month). Needless to say it was turned over for collections. I was not surprised and figured if I EVER got enough money to pay them off I would, until then I will suffer the bad credit report. My question, is it legal for them to also put this as a collection account on my spouses credit report? His name was nowhere on this account nor did he ever sign anything linking him to this account. He was recently denied a loan because of this item on his report.
