Legal Question in Credit and Debt Law in Texas

Default Judgement On A Credit Card Debt

I was served a citation, by a delivery service, needing my signature. (not a sheriff) It states that I have been sued for not paying on a credit card and if I do not file a written answer in 10 days with the clerk who issued the citation, a default judgement may be taken against me. I called the clerk that issued that citation and was told that I need to appear on the date that it states on the citation. I told her that there was not a date just that I have 10 days to file a written answer. She made it sound like it was no big deal so I gave her my case # that was located on my citation and my name so it would be notated that I called. well, I just received in the mail a small 5x10 index card that says I have a default judgement with some court fees. I called the court cause I had no idea what to do and was not given the correct information. I have never had anything like this happen before and I don't know what to do? I called and called the credit card company for help cause with a 21.4% apr and making $200 monthly payments my $1000.00 balance was never going down and I needed to eat. Now they are trying to say that I owe them $1,900.00. What can I do? Is there going to a default judgement on my credit report?

Re: Default Judgement On A Credit Card Debt

A default judgment has been entered against you and will probably eventually show up on your credit report. In Texas, judgments earn interest at 5% per annum. You have ten days from the date of the entry of the judgment to file an appeal with the justice court. If the time has not run, I would urge you to appeal ASAP.
