Legal Question in Credit and Debt Law in Texas

default judgment

I was served a suit by a collection agcy. for a credit card debt of aprox. $4000. In the meantime we agreed on a ''Court Monitored payment plan'' & I was told I need not appear in court & would get a written copy of the agreement. Now after 4 mos. I have paid about $1400 & still not received anything in writing. The collector says I have to make the payments regardless or they will seek a default judgment. My wife recently lost her job & we need to get our payment lowered. How can we accomplish this and protect against a default judgement? Thanks.

Without seeing documents, it is hard to tell. Call and or email documents..but debt collector seems to be shady and you may not have any need to continue payments..but may have case against them..
