defendant in civil case
i am being sued over a repossession from 2003. state farm is the plantiff. the remainder of the note is about 17 thousand. i am being asked to reply. if i do not, a default judgment will be taken against me. what does that mean? will they make me pay? or will it just mean that it will go a record that i owe state farm money?

Re: defendant in civil case
If you do not respond, and they take a default judgment, then they can also ask for damages, attorney fees etc that may be allowed by the contract, thus increasing the judgment. They can then begin a search of assets to seize in execution of the judgment. If you file a response, you can probably negotiate a lesser payment to satisfy the case, resulting in a dismissal. Some lawsuits require different types of answers, so you should consult an attorney. Your answer needs to be filed before twenty days after the first Monday following service of the lawsuit. TCL
