Legal Question in Credit and Debt Law in Texas

executer of will & power of attny

My mom is 74 and lives in Dallas TX. She has made me executer of will & POA. If she were to die and her house goes into foreclosure would I be responsible for her debts? She has major credit card debts. I realise if there was any money in the house it would go to her debts. My name isn't on any credit cards of hers and I live out of her state.

Thank you

Re: executer of will & power of attny

An executor is never personally responsible for the debts of the deceased, unless the executor has made a distribution of the estate without first paying the known debts.

You will not be responsible for your mother's debts. What you may have to do is to try and sell her house (after she dies, of course) to raise money to pay off the known debts.
