Legal Question in Credit and Debt Law in Texas
Exemptions if judgment rendered
If all you have are your wages, a 401k payment that you have automatically deducted from your paycheck, a checking account the money in which is your wages, your homestead, and 2 cars, and you're married, what can a credit card company ''take'' or attach a lien/levy to in Texas?
Also, if the debt was sold by the original creditor to a collection agency/attorney, and charged off, can the original creditor still file suit against you?
Thank you!

Re: Exemptions if judgment rendered
The bank accounts are fair game for a creditor to execute a judgment against.
The entity that has retained rights to the debt has the right to sue.
