Legal Question in Credit and Debt Law in Texas

Expiration of bad debt

I have been contacted regarding a debt to an automotive entity that is over 10 years old. To my knowledge there has been no previous attempt to collect. This is a collection agency that says they just purchased the paper--I was told years ago it was written off. It's not a huge amount, but I don't think I owe it. Is there a time limit for collection. The person handling said ''I had to get back with him right away or he would be forced to call me back'' I am a professional that has moved into a nice career in the last decade. I really don't want the harassment and embarrassment. What should I do?

Re: Expiration of bad debt

The statute of limitations to collect a debt, in Texas, is four years. A debt may be reported on your credit report for seven years from the date of last delinquency. Both periods have passed. Tell the collector to cease and desist from any and all communications to you. If you know their name, send a cease and desist letter to them in writing. If they persist, you have a claim under the Fair Debt Collection Practices Act.
