Legal Question in Credit and Debt Law in Texas

Fair Billing

I bought a couch on credit. Never received a billing statement in the mail (the first 3 months were free). I get a call out-of-the-blue saying my account is delinquent, and unless I make an immediate payment, my account will be sent to collections (the creditor admitted they messed up my address, so all the paperwork was being sent back to them). My question: What are my rights -- Must I make an immediate payment, or am I entitled to advance notice and time to make the payment that's due?

Re: Fair Billing

You are responsible for your debts. The billing is actually a courtesy and not an obligation. If you can, you should make the payment that is demanded. If you can't, let your creditor know what you can pay right now and when you can pay the balance. Since it was their error that contributed to the mess, they may work with you.

Just remember that they are not required to cut you any slack.
