Legal Question in Credit and Debt Law in Texas

False credit reporting

A five year old auto reposession account has recently been sold to a collection company. The collection company is now reporting the information as if it was a credit card account. I have disputed the false information through the credit bureaus, but the information continues to remain unchanged. This is NOT and never was a credit card account. What other options do I have to remove the false information?

Re: False credit reporting

This is currently a common happening. There are several credit card companies who are doing this, buying old debt and re-aging debt. It violates both the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. Unfortunately, it will probably require a lawsuit to correct. I recommend you contact a lawyer who is a member of the National Association of Consumer Lawyers, at www.naca.net.
