Legal Question in Credit and Debt Law in Texas

Family Loan

Back on July, 2005 our dear mother passed away. We are a family on 3 brothers and 3 sisters. All male were able to pay for mother's funeral expenses, or atleast their part. So, each sister who isn't working were also to put in their part. How I don't know. But anyway, we had a brother who suggested he would use his credit card and made up a contract to pay him back the amount owed by us individually. There was no specified date to pay off or no amount specified to pay. He left it up to each of us to put the amount that we thought we could pay. So, we each signed. Now, he's telling us he's going to take us to court to pay him off. Is this legal if we had already agreed to pay per our promissory contract and we have been paying as per his conditions? Please advice. Since he's giving us only until Dec. 15th, 2005.

It's legal to sue for an unpaid balance. He has some very serious proof problems concerning how much and when.
