Felony Charge of Unauthorized Use of a MV
I subleased a vehicle, rather naively i might add, a few years ago. I have a notarized contract, with copies of both of our licenses and signatures. The person stopped making payments & a year ago, I was contacted requesting information on where the vehicle was. I gave them the info, they spoke with the individual and I assumed it was taken care of...again also naive! I got a writ of investigation today & was told to appear in court on Monday to be formally charged with this offense. The offense is a felony, and I am currently on deferred adjudication for a misdemeanor. A new offense would be a violation even though I have fulfilled 10 out of 12 months of the community supervision successfully. What are my options? How can I avoid prosecution? Is he also liable considering we have a contract? The penal code states the violation must consist of the intent to conceal or damage the property for which the lien was assessed, and I did not do that. I gave them the information & they did not pursue it. PLEASE HELP ASAP!!!

If you want any chance of avoiding prosecution, and avoiding a revocation, you need to hire a lawyer before Monday.
