Legal Question in Credit and Debt Law in Texas
foreclosured on and didn't know it
I co-signed on a mortgage in 2002. In May 2006, the persn I co-signed for defaulted and I did not know. In Dec, 2006, I discovered I had been foreclosed on when I had my credit pulled. I was never informed in any way as the mortgage co (a big co), only has room in their system for 1 contact phone/address. With todays technology, I am furious as due to that, I never knew and was not given the opportunity to try to prevent the foreclosure. They give you 6 months from beginning of default to foreclosure... but not if they don't have a way to contact you. And I understand they have to make a certain amount of effort. Only having 1 contact phone/address is NOT making enough effort. I am sure tons of other folks have had same thing happene. Looks like a good thing to bring up and see about doing something about. A person should not have a foreclosure on their credit when they were never eve given the chance to prevent it. After all, my grandkids Ipod can hold more data than the mortgage company's system I guess and being a 23 year computer programmer, I am simply furious. This foreclosure is devastating to my ability for lots of things. Is there anything I can do ?

As a person responsible for the debt, you had a right to legal notice. Sometimes people overlook these things, but if you sure you didn't get a lawsuit from the court, contact me by email. You may have valuable legal recourse if you want to pursue it.
