Legal Question in Credit and Debt Law in Texas

Fraudulent Charges after return of auto lease

We recently fulfilled an auto lease with US Bank. THEIR hired inspector came out & instructed us to replace drivers armrest, as well as 1 front tire & took pictures of the car (garage kept, 10k under mileage & in imaculate conditon). We had upgraded vehicle with 20'' tires & rims. We were never instructed to replace stock rims & tires upon return of vehicle. We replaced 2 front tires (eventhough only 1 was required) and faxed confirmation of replacement (which indicated a 20'' tire size on bill) to US Bank. Upon return of Tahoe to authorized dealership, the dealership immediately bought the car from US Bank (for $2k less than US Bank offered us to buy out lease just the day prior!) Dealer then resold the car to new customer within 24 hrs. Afterwards, US Bank forwarded us bill for $395 early termination as well as $2600 for turning in w/o stock tires!?? How can they bill us for a car they no longer even own or posess, not to mention already profitted off sale of!?? They're threatening to ruin our credit if we don't pay! Contacted General Mgr at dealership who also agree we are NOT responsible (and no longer uses US Bank for their leases), but also local lawyer, who says US Bank can (& will) report to credit if we do not pay

I agree with the local lawyer, and believe that your recourse is to sue them first.
