Legal Question in Credit and Debt Law in Texas
Furniture finance woes
In Oct.2002 we bought a suit of living room furniture from Roomstore for $1800, had it financed.. salesman told us several times the sofa/loveseat was made by Sealy & had a 5 yr. warranty. About a year after, the sofa started falling apart, coming unsewed at seams, handles for recliners breaking, frame breaking. I called Roomstore, the style was already discontinued and the salesman who sold to us had left the co. No one believed that he had told us our furniture had 5 yr. warranty. Rockline was the real manufacturer and they only had a 1 yr. I wrote them and received no response. I stopped payments on acct hoping it would get repo'ed but they didnt want it back. I learned I had to pay for somebody to come out and fix sofa, no one would honor warranty. We still have furniture, still falling apart, and now a debt collection law firm has written us and the balance on acct. is twice what it was when we stopped making pmts.
I have written all collection agencies, Roomstore and the manufacturer every step of the way about the problems we are having. Theres no way I can pay the $4700 theyre demanding now. I dont know what else to do. What other recourse do I have & would it help or hurt to write same details to that law firm? Thank you

Re: Furniture finance woes
It's too late to take any positive action against Roomstore. You are on the hook for the finance note, so your best approach is to try and negotiate a payout settlement with the attorney that represents the creditor.
Contact an attorney in your area, let them know what's coming down, so they may be able to file a counterclaim against Roomstore when a lawsuit is filed against you.
