Garner Wages?

My wife and I have fell on hard times, and we are considering whether to file for bankruptcy. However an attorney for a credit card company we have fallen behind on, contacted my wife (the credit card is in her name) and stated that he would be contacting the HR department of her company in order to begin garnishing her wages. Can they do this in TX?

No. Creditors cannot garnish wages in the State of Texas. Texas is one of three states where garnishment is not permitted. The only exception is the IRS, government guaranteed student loans and child support. Once a judgment is obtained, a creditor may garnish a bank account. That is the extent of garnishment in Texas.
