Legal Question in Credit and Debt Law in Texas

Garninshing Wages on Repossessed Car

I live in Texas. Two years ago I relinquished a vehicle to repossession because of low wages and an ill ex-husband and daughter to support. After the creditor sold the car I was left with an eight thousand dollar balance which I still can't pay. I could not afford the three hundred dollar monthly payment back then and I definitely can't pay now. I continue to work plus I now attend a university full time. I received a threatening phone call that they were going to file some type of legal action to garnish my wages. I only net eleven hundred dollars a month to pay rent, food, gasoline, and necessities for my daughter an me. I also receive medicaid for my daughter. What can I do? I am horrified. I have told them every time of my situation. Should I file Chapter 7 bankruptcy? Will bankruptcy harm my financial aid for school? I would greatly appreciate a response. Thank you.

Re: Garninshing Wages on Repossessed Car

They cannot garnishee your wages! You might want to speak with a bankruptcy attorney before making that decision, and you'd certainly want to wait to see if they file a lawsuit against you. Right now all they are doing is making threats to see if you'll pay.
