Can they garnish wages

What can Povidian Bank do to me on an unsecured credit card debt of $2000.? I do not work and card is in my name only. What can the same company do to my husband for a card of $1900. He lost his job in November of 2001 and just got one this week, it is less pay and I tried to work with Providian and with collection agency mine has gone to. They refuse to deal with less payments even for temporary period. Can they garnish his wages? We only have one car and it is owed against, everything else is personal junk. What can they do to us?

They can't garnishee wages in Texas, and they can't take your car; only the lender who gave you credit to purchase can do that if you default on payment. Both you and your husband are obligated on the credit card, since Texas is a community property state. If they can find a bank account they can garnishee that, but they can only try to get property after they sue you.

Write to them. Explain what your circumstances are, and state what you can pay on a regular basis. Don't rely on the phone, since there's no record of what's been offered.

If they're going to sue you, an attorney will get in touch with you. That'll give you another chance to negotiate a payout.
