Ex Girlfriend making late payments on co-loan for car.
I purchased a car with my Ex-girlfriend over a year ago. Both of our names are on the title(mine comes first) and on the loan I am the co-signer. Since then the finance dept. for the car has told me my name has been reported to collections 6 times for late payments. My Ex will not talk to me or make on-time payments. The last one made was over 20 days late. She has had posession of the car since it was bought.
So my question is: Can I pay off the loan that is left on the car, which is over $10,000, and then repo the car from her? I also made a down payment on it which was about $3,000 which would have me as paying more than half the cars retail value at purchase.
Can she retaliate? I think she is purposefully making late payments to ruin my credit.
So, If I pay off the loan, and my name comes first on the title, is it worth reposessing the car from her? What kind of mistakes can be made that I should avoid? What is required?

You can pay off the loan, but the title will have both your names on it. You can repossess it, but she has equal rights to it.
