Legal Question in Credit and Debt Law in Texas
government student loan repayment
I attended a technical school to get my degree in the mechanic aviation field. Because the school was not in compliance with the FAA regulations, the owner filed bankrupcy and shut the school down without any warning to the students. As a result, Texas Guarantee is agressively trying to make me repay a student loan which I did not receive my education. I am unable to retrieve any of my school records.
What can I do to get out of this government student loan? Is bankrupcy my only option? Texas Guarantee doesn't care I did not receive my full education and trying to garnish my wages.
Can I file a suit against the owner of the school? He currently owns another business.
I spent two years of my life with nothing to show for it, nor can I use my education to go into the field since the FAA requires records of my education in order to take the FAA test.

Re: government student loan repayment
I hate to tell you this, but bankruptcy will not discharge a government-backed student loan. You may not be able to sue the SOB if your debt was discharged in bankruptcy. It may be worthwhile to check the bankruptcy records and see if you were listed as a creditor. If not, he may be fair game.
You might also get in touch with the bankruptcy trustee to see if he or she has access to the student records.
