Legal Question in Credit and Debt Law in Texas

Harassment by Credit Card Company

The credit card company calls every 1-3 days for collection on an account. We make arrangements to pay on payday (normally 15th) and because we will not Post-Date a check with them on the phone they continuously call. We have made agreements to lower the interest rate which they fail to follow after we make the payment for the lower interest to take effect. How can I stop the daily calls and what is the legality of post-dating checks?

Re: Harassment by Credit Card Company

I would not deal with a collection agency under any set of circumstances. Send them a letter telling them to cease and desist from all communications with you, that you prefer to deal with the original creditor as is your right under the Fair Debt Collection Act. Send a copy of the letter to the original creditor. After allowing time for original creditor to get the letter, call them and work out a payment plan with them or just start making payments to them.
