Legal Question in Credit and Debt Law in Texas

Hasseled for over 5 yrs over bad credit card debt.

I had a house fire and found out afterwards that I had no content insurance. I became unable to pay on my credit cards. I have one that continues to call constantly. I realize that i owe the debt but my funds are so far stretched that i can't pay. My last payment on this card was in Nov. 2000. How long, or what is going to happen to me? I have been a horrible wreck all these years. And how long before it comes off at the credit bureau?

Re: Hasseled for over 5 yrs over bad credit card debt.

I've got good news, and bad news. The good news is that the statute of limitations for a lawsuit on the credit card debt ran on December, 2005. Any suit is barred by limitations, and if they pursue the matter, they are in violation of the Fair Debt Collection Practices Act.

The bad news is that the debt stays on your credit report for seven years from the date of default; it should come off January, 2008.
