Legal Question in Credit and Debt Law in Texas
I had a heart procedure done at a cardiologists office last January. My outstanding balance (after insurance paid their portion) was approximately nine hundred dollars. The office was sending me a monthly statement as to which I was making a fifty dollar (monthly) payment. Since May the monthly statements stopped. Me, having assumed my insurance went ahead and took care of the balance, stopped making payments. Now all of a sudden I am receiving threatening letters from a collection agent. I spoke with the cardiologists office and they said it was my responsiblilty to make a payment plan with them. Well I thought I already was! I was getting a monthly statement and making monthly payments! I only owe them approximately six hundred dollars now. Doesn't that count for something? Now they won't deal with me. I'm having to deal with the collection agent which is not pleasant at all. Their saying if I don't pay them in full they will turn it over to the credit bureau. Is this right? My first question is isn't the cardiologist supposed to send me a notice stating they are turning me over to a collection agent? I received nothing. And second, if I'm making payments to the collection agent ( which I've already made one) can they turn it over to the credit bureau? I have excellent credit, I'm very responsible, and I pay my bills on time. I am insulted and angry. I was doing exactly what I was supposed to be doing and now I get this! I feel as if I have no rights here. Help! This is a free question, not a paid question. I am requesting a free answer. Thank you

there is no legal way to stop collection efforts...but if it is on your credit report, disputeit and frequently it disappears
