Legal Question in Credit and Debt Law in Texas
Hello-I have a question about debt/collections. Last year I took out a payday loan and unfortunately defaulted on it and since then it has gone into collections. I recently received a call from a gentleman claiming to be an officer, who read me an affadavit over the phone stating that charges were being filed against me and that if I didn't have a lawyer one would be appointed to me, etc. He stated that I could settle the case out of court I just needed to let him know what I wanted to do. I told him I would need to call him back as it sounded a little fishy; can they just call and read me the affadavit and serve me over the phone? ANd how can I verify if he is really an officer? Thanks!

Hopefully you got names/addresses etc..as that is gross violation of the law..but you can sue the collector and lender..problem will be proving that you were called..and what was said.
