Hit by drunk driver

My husband was at a red light and was hit by a drunk driver. That person was arrested and deemed at fault. They did not have insurance. My husband was in Corpus Cristi on a business trip. He rented the car in his name because they get reimbursed when they submit the expense to their company. The boss was going to pay for damages, because his insurance did not cover rental cars. The boss decided not to pay, so the rental company is coming after us. We do not want to pay because he was not responsible for the damage-because he was on work time and the drunk hit him. Why should we have to pay?

You say he is not responsible because he was on work time, and because a drunk driver hit him. However, you fail to mention the terms of the contract he signed. The answer to your question is likely because he AGREED to be responsible.

You have to pay because he is responsible under the contract he signed. However, unless he did something foolish and drove without insurance, either your own car insurance policy may cover him, or any insurance he bought on the rental car may, so check your policy and papers and make a claim promptly.
