Legal Question in Credit and Debt Law in Texas

My HOA assessed damages to my condo after hurricane Dolly, but never did repairs, so I refused to pay my maintenance fees. Now they are threatening to foreclose on my property. What can I do to prevent this?

What does your agreement say? Are they obligated to make repairs? Do you have the right to withhold fees if properly noticed? Read the agreement, it will govern the outcome, if it is an enforceable contract. If you are in the right, sue them.
