Legal Question in Credit and Debt Law in Texas

identity theft

identity theft. I was successful in proving my case to the credit bureaus. The item was removed, but nearly 6yrs later someone has purchased some old notes and are trying to collect funds. They now want to take me to court can they do this and what type of garnishment will happen because i don't have any moneies. Since I live in Texas a non garnishing state can they take money from my acct. How do I fight this. I thought I had put up a good fight about the identity theft and now 6yrs later having to clear my name all over again. Help

Re: identity theft

Write to them, certified mail, return receipt requested, and tell them that you dispute the debt because it was caused by an identity thief, that any further action is barred by limitations, and if they attempt to pursue this matter it will be a violation of the Fair Debt Collection Act and legal action will be taken.

That should bring it to a great, screeching halt.
