identity theft-holding the company liable

I recently found out an employee in Texas is using my SSN. I live in California. I contacted the appropriate agencies. However I also called the company that he works for. They said they might not have checked his SSN upon hire correctly. Could they be held liable for that?

There are different penalties for not properly checking the SSN. Did this cost you anything? We might be able to get them for that.
