Legal Question in Credit and Debt Law in Texas

Judgement on home

I have had a judgement lien against me and has been aplied to property I live in [homestead].I have lived in this house for 16 years and the judgement has been running for about 12 years. It was renewed a couple of years ago some where in between my refinance of my home for when I refinanced two years ago it did not exist.I currently am working over seas on a contract and want to rent my property to cover the payments,I believe this will drop my homestead protection ,I want to know if this will allow the judegement holder to come and take my house from me while I am away. The house has a lot of equity in but not enough to cover the judgement.

Re: Judgement on home

As long as you have an intent to return to Texas and live in this house, it remains Texas homestead. You could always cancel any lease and pay damages to return to your homestead if you had to.
