judgements please help

I am having ajudgement filed against me. I am being served tomorrow. This debt happened before I was married will it affect my husband and how long will it stay on my record. Can I file bankruptcy without my husband?

First, it is incorrect to say you are having " A judgment filed against you" if you are just now being served. A LAWSUIT has been filed against you and you are being served with a copy of the lawsuit. You have an opportunity to answer and defend. A judgment is not automatic - they have to prove their case. There will be no judgment until there is a hearing or a trial, both of which you should have advance notice of. The statute of limitations for suit on a debt is 4 years in Texas. Debts may stay on your credit record for 7 years from the date of last activity. If this is your only problem, I would not recommend filing bankruptcy. If this is your sole individual debt, it should not affect your husband. You shouyld consult an attorney because these cases may be sucessfully defended.

Sharon Campbell gave a good answer...see an attorney..we have helped people defeat those claims..but do not just let them take a judgment...it does not affect your marital property, nor your spouse..
