Judgment

Several credit card companies are filing judgments against my 80 year old father, who is very ill and is cared for by family. His only income is Social Security and he owns nothing other than his personal clothing and a few furniture pieces. One company has filed a judgment against him. Can they take his Social Security from him? What happens with a judgment?

Re: Judgment

Social security benefits are exempt from creditors. A judgment may be filed of record and, if so, it operates as a lien on all his non-exempt property. It will also show up on his credit. A creditor with a judgment can garnish a bank account, however, if you can show that the only money in the account is from social security, they will not be able to garnish it.
