judgment on debt
I divorced in 1979,was given the debt to LTV for $2700. Spouse failed to pay child support-debt went to collections. A Judgement was filed against me & spouse(community property state)-I settled and paid them for 1/2 debt(LTV said spouse was responsible for balance, no matter what the court papers said). Now, 25 years later, LTV has attached spouses ckg acct for $8000.00. He says I'm in comtempt of court now. I do not have any paperwork that old..What do I do?..Do I need an attorney in ID or TX?..Can LTV come back after 25 years?..and am I in contempt of court since I did settle with debtor(they stated the amount due)?..help

Your explananation is not clear to fully understand your situation. If you are talking about collecting on a judgment, a judgment is good for ten years and, if renewed, is good for another ten years. If the debt has not been reduced to a judgment, the statute of limitations is four years to collect a debt. If it has to do with collecting a judgment that was rendered against both of you, the creditor may collect against either or both of you as they choose. If they choose to collect the remaining debt from your ex-spouse, they are perfectly within their rights to do so. I don't follow how you could be in contempt of court. The divorce court said he was responsible for half of the judgment, right? If he has not paid any of it until now, the amount has probably grown substantially because of interest on the debt. It would be very helpful, however, if you could locate some documentation showing that you paid half of the debt some years ago.
