Legal Question in Credit and Debt Law in Texas

Judgment

I was served papers for a judgment hearing. The debt is for a unsecured line of credit from a private bank (Bank of Houston) in Texas. This debt was from 1998 and reworked in 2000. I now live in FLorida and have lived for here 5 years. The bank is also no longer a private bank but is now Whitney National Bank. Can I be served papers for a debt that was made in Texas 4-5 years ago? By a bank that was private but now was bought by a national bank?

Yes. Banks can sell their commercial paper to other banks or entities. There may be a statute of limitations problem. In any case, you really need to hire an attorney to represent you and look into this. Worst case, you may want to work out some type of settlement arrangement, especially if you are in Florida and don't want to come to trial in Texas. If you do nothing, you risk having a default judgment rendered against you. If the case is in the Dallas area, feel free to contact me.

Your question is not clear. A Texas judgment is not effective in Florida until they domesticate the judgment here.
