Legal Question in Credit and Debt Law in Texas

We applied for and received a consolidation loan and refinanced our home. We were obviously not doing well financially at the time since we took a very high interest rate to get the loan. We gave all the information to pay off our debts. Instead they gave us a check for cash, which of course we did not pay what needed to be paid. We are now in worse financial trouble than ever and even though it is entirely our own fault, we are frustrated that is was not done properly. Are they to blame in any regard? Is there anything we could do to fix this and do it correctly? We have two children in college, I am in between jobs and we are in trouble.

You seriously want to hold them responsible for writing you a check? You want to advise the court that you were not mentally competent? You stated it is entirely your own fault.
