Legal Question in Credit and Debt Law in Texas

law suit

I was sued over an unpaid credit card. I answered the suit to the court with a complete denial of ever having the credit card. A few months later i got a notice of dismisal if the plantiff did not pursue the claim. Then i got a letter from the courts that the plantiff asked for an extention that goes till march 31 2009. What can i expect? Im married and have two children we are buying our house and it is homesteaded. What is the worst that can happen? Can they garnish wages, can the seize our bank account? I have heard they really cant do anything execpt put a judement on your credit report. If thats truely the case then why do they even bother taking these cases to court? Is this a last ditch effort to get me to pay?

My wife and i have encountered financial dificulties over the past few years that led to these issues.

Re: law suit

if they get a judgement, they could garnish your bank account and have a constable/sheriff seize any non exempt property you have...and when you sell your home, though exempt, closing may require payment of some sort...and they can take your deposition to see if you have anything..but it depends on how mush you owe..e.tc..
