Legal Question in Credit and Debt Law in Texas
Can a lawyer demand payment & atty fees without giving me proof ?
I used a pool service last year. I called them up by telephone and set it up for them to come out 2x monthly at a cost of 70 dollars a month. All of a sudden, I started receiving larger bills, so I canceled my service. They did not stop the service and they continued to send the bills.
I was contacted by an attorney demanding the full payment and I sent a certified letter back disputing the charges. He did not respond to me and he sent a second demand letter this time demanding attorney fees of 200.00.
I have no problem paying my debts, but I do not owe this company the monies they claim.

The lawyer can demand payment, but that doesn't mean his client is entitled to payment. Depending upon the amount of money involved, you may want to hire a lawyer for a nominal fee to respond to the demand letter. It may resolve it before it goes any further.
