I hate to bother you but I need some legal advice, my Brother-in law Don needs to sell his property behind his home to pay taxes on his home. Here is the problem; he has a lean on his home for a truck that he let go back. He can't sell his lots behind his house because of the lean on it. They want take the lean off tell he pays it. My question is there a legal way to sell the land and go pay off the truck without first selling the land. What do we do? Could you please help? Thank You

You need ot contact the people who put the lien on the property and make arrangements to pay them off out of the proceeds of the sale. The sale proceeds can be made out in 2 checks - one for the lien holder and one for Don. Be sure and get a release of lien at the same time the check is delivered.
