Legal Question in Credit and Debt Law in Texas

legal status of a fax receipt

A hotel sent us several invoices through faxes that showed a total amount which we paid to date. Twice I was required to sign and send the fax back, which I did. We received several more faxes with the same amount paid to date. Then on the day of arrival at the hotel, we were told that we still owed money according to their computer even though we had paid the balance remaining. Does the fact that we signed several faxes and sent them back and no attempt was made to notify us of the error make the balance on the faxes correct? Or do we have to show a seperate receipt for the balance paid? We paid the inital balance in cash.

Re: legal status of a fax receipt

Not quite sure what your question is, but if you claim to be paid up, and they claim you are not, it will be up to you to prove that they've been fully paid. If the balance was paid in cash, and you didn't get a receipt to show payment, you've left yourself open. A fax may be proof of payment.
