Legal Question in Credit and Debt Law in Texas

Liability to family of unpaid credit card debt after moms death

My mom died last week of cancer. She left a will leaving everything equally to me and my 2 brothers. She left us 3 small life insurance policies (2 of which went to the funeral home to guarantee payment for their services)My brother has power of attorney over her affairs. She has approximately $20,000 in credit card debt and owned nothing except a small tract of land she inherited in rural Oklahoma appraised at $17,000 which is not very marketable. She had no other assets. Are my brothers and I liable for her debt ? Can we send a copy of her death certificate to these creditors with any success of ending collection efforts ? Because of medical expenses and nursing home care during her final 2 months, we have been unable to pay her bills. The nasty letters are starting to come in. What should we do ? Your help is greatly appreciated.

no you do not owe the debts..the estate may if probate occurs..but creditors need to make claims..against estate..not heirs...are letters coming to your mother or you individuals..and if so, write them you don't owe, will not pay and if they harass more..sue them
